ACCEPTANCE OF TERMS
By using the Pomona College Alumni Portal ("PCAP"), you signify your agreement to these terms of service. If you do not agree to these terms of service, you may not use the PCAP Site. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these terms of service at any time and without notice to you.
DESCRIPTION OF SERVICE
Through the PCAP Site, users are provided with a variety of online services, including but not limited to an alumni directory, e-mail forwarding addresses, personal information updating, and personal privacy controls. You also understand and agree that the Service may include certain communications, such as service announcements and administrative messages, and that you will not be able to opt out of receiving them. Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including upgrades and the release of new portlets, shall be subject to these Terms of Service. You understand and agree that the Service is provided "AS-IS" and that Pomona College assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. You are responsible for obtaining access to the Service and that access may involve third party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access the Service. The College reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that the College shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
ALUMNI DIRECTORY PRIVACY STATEMENT
The alumni directory is for official use of Pomona College and for individual communication of a personal nature between those listed herein, as well as faculty, staff and students of the College. Use of the directory for any other purpose, including but not limited to, reproducing and storing in a retrieval system by any means, electronic or mechanical, printing or use of the addresses or other information contained in this directory for any commercial or political mailing (whether postal or electronic) is strictly prohibited. All information contained herein remains the property of Pomona College, and the directory may not be reproduced in whole or in part by any person or entity without the written permission of the College. We have attempted to verify and correctly state the information contained herein; however, Pomona College disclaims all liability and responsibility for the accuracy of this information. In addition, circumstances may have rendered some information herein obsolete prior to the time the information is reviewed by the user. We apologize in advance for omissions or errors, and urge you to send corrected data to Pomona College. The user is encouraged to contact Pomona College to obtain any updated information.
ACCOUNT, PASSWORD, AND SECURITY
You have received a personalized user ID and password, which allow you to register on the PCAP Site. You are responsible for maintaining the confidentiality of your user ID and password, and are fully responsible for all activities that occur under your account. You agree to (a) immediately notify Pomona College of any unauthorized use of your user ID or password or any other breach of security, and (b) ensure that you exit from your account at the end of each session. The College cannot and will not be liable for any loss or damage arising from your failure to comply with this section.
HOUSE RULES
The following is a list of the House Rules of conduct for the PCAP Site. By using the PCAP Site you agree not to do any of the following:
1. Post, distribute, or otherwise make available or transmit any data, text, message, or computer file that we deem to be: (a) defamatory, abusive, harassing, insulting, threatening, or that could be deemed to be stalking; (b) bigoted, hateful, or racially offensive; (c) vulgar, obscene, or sexually explicit (language or images); or that (d) encourages or advocates illegal activity or the discussion of illegal activities with the intent to commit them;
2. Post, distribute, or otherwise make available or transmit any data, text, message, computer file, or other material that infringes and/or violates any right of a third party or any domestic or international law, rule, or regulation, including but not limited to: (a) copyright, patent, trademark, or other proprietary rights; (b) right of privacy (specifically, you must not distribute another person's personal information of any kind without their express permission) or publicity; (c) any confidentiality obligation;
3. Advertise or sell any products, services or otherwise (whether or not for profit), or solicit others or use any information for commercial purposes of any kind,
4. Post, distribute, or otherwise make available or transmit any software or other computer files that contain a virus or other harmful component;
5. Impersonate any person or entity or misrepresent your identity or affiliation with any person or entity;
6. Engage in antisocial, disruptive, or destructive acts, including "flaming," "spamming," "flooding," "trolling," and "griefing" as those terms are commonly understood and used on the Internet;
7. Delete any legal notices, disclaimers, or proprietary notices such as copyright or trademark symbols, or modify any logos that you do not own or have express permission to modify;
We reserve the right to remove any material, and if we deem appropriate, to turn over to law enforcement officials, any material, including message, e-mail, or posting, that is in violation of these House Rules. We also reserve the right to comply with any order or otherwise cooperate with law enforcement officials regarding the identification of any user alleged to be using the PCAP site in violation of the law.
TERMINATION
You agree that Pomona College may, under certain circumstances and without prior notice, immediately terminate your PCAP account, any associated e-mail addresses, and access to the Service. Cause for such termination shall include, but not be limited to, (a) breaches or violations of these Terms of Service or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) discontinuance or material modification to the Service (or any part thereof), (e) unexpected technical or security issues or problems, (f) extended periods of inactivity, and/or (g) you have engaged in fraudulent or illegal activities. Termination of your PCAP account includes (a) removal of access to all offerings within the Service, including but not limited to the alumni directory and e-mail forwarding addresses, (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and (c) barring further use of the Service. Further, you agree that all terminations for cause shall be made in the College's sole discretion and that the College shall not be liable to you or any third-party for any termination of your account, any associated e-mail addresses, or access to the Service.
